The Special Assistant on New Media to the Senate President, Bukola Saraki, Oluwole Onemola has condemned the suspension of the Chief Justice of Nigeria, CJN, Walter Onnoghen.
Buhari had on Friday suspended Onnoghen and immediately appointed Tanko Mohammed as acting CJN.
Reacting, Onemola said Buhari had no right under the constitution of Nigeria to suspend Onnoghen.
In a series of tweets, he stated that the constitution makes it clear that a CJN can’t be removed either temporarily or permanently.
He tweeted: “President Buhari has NO RIGHT and no power under the Constitution and the laws of the Federal Republic of Nigeria to suspend the Chief Justice of Nigeria.
“The Constitution of the Federal Republic of Nigeria, 1999 is very explicit on how to remove the CJN in Section 292(1)(a)(i).
“Section 292(1)(a)(i) states that “A judicial officer shall not be removed from his office or appointment before his age of retirement except in the following circumstances, in the case of [CJN] by the President acting on an address supported by two-thirds majority of the Senate.
“The Constitution leaves no room for the removal of the CJN from Office, whether on a temporary or permanent basis other than by Section 292(1)(a)(i).
“Nigeria is a nation governed by laws, the President owes Nigerians STRICT compliance with the provisions of the Constitution.”
